Digital Millennium Copyright Act
Introduction
Saint Joseph's College's policy is to comply with provisions of the Digital Millennium Copyright Act (DMCA). It is illegal, as described in the DMCA, to download, upload, or distribute copyrighted material in any form without permission to do so from the copyright holder. Sharing (uploading or downloading) digital copyrighted material, including copyrighted music, movies, and games is not permitted by the College's Computer Use Policy.
Campus computer users are ultimately responsible for any misuse of their personal computers on the College's network, even if they are not aware that copyrighted works have been downloaded to their PC, and even if they did not personally install the filesharing software or initiate the file downlods.
The and use of popular file sharing programs like KaZaA, LimeWire/FrostWire, Morpheus, iMesh, BitTorrent, Vuze, uTorrent, Gnutella, etc. to illegally share copyright materials is not permitted. Instead, users are encouraged to find legal alternatives to downloading copyrighted works. Because of the wide-range of file-sharing programs, and the many types of computers in use on campus, Computer Center staff are not able to help with removing or blocking access to copyrighted material on personal computers that are not owned by Saint Joseph's College. While Saint Joseph's College does not monitor its network for copyright violations, complaints by copyright holders or their agents, provided they have followed the necessary DMCA protocols and have a valid complaint, are taken seriously and may result in loss of network access, fines, penalties, or legal action.For more information, visit the Respect Copyrights website
DMCA Complaint Process
- Saint Joseph's College responds to each DMCA notice that meets the minimum requirements described in the DMCA legislation. The DMCA requires that copyright infringement claims should be submitted to the College's designated DMCA agent, either in writing to

Please refer to the DMCA legislation for specific information that must be included in a valid DMCA complaint. - Each DMCA complaint is reviewed by the DMCA Agent for accuracy, and to verify that it meets minimum DMCA requirements. Valid complaints are then logged, and referred to the Saint Joseph's College Computer Center.
- Upon receipt of a complaint from the DMCA agent, Computer Center staff use the network address provided in the complaint to search for a corresponding network login id, and then review DMCA complaint history files to determine if this is the "first complaint" received against this login id.
- If it is the "first received complaint" for a login id,
- Computer Center staff block the user's networked PC from connecting to the campus network.
- Computer Center staff also send the user a copy of the DMCA complaint notice, along with instructions that they must remove the copyrighted material from their PC and/or block access to the copyrighted material on their PC before their Internet access will be restored.
- Users are required to come to the Computer Center, and to sign a "DMCA Complaint Acknowledgment" form confirming that they (a) received a DMCA complaint, (b) understand that electronic sharing of copyrighted material, without permission of the copyright owner, is a violation of the College's Computer Use Policy, and (c) they have removed or blocked access to the copyrighted material.
- Users are also informed of possible consequences if they receive additional DMCA complaints in the future. Computer Center staff then file a copy of the signed DMCA Complaint Acknowldgment document and restore network access to the user's computer within two working days.
- If a previously resolved complaint and a signed DMCA Complaint Acknoledgement form are on file for this user,
- Computer Center staff block the user's networked PC from connecting to the campus network.
- Computer Center staff send the user a copy of the DMCA complaint notice, along with instructions that they must remove the copyrighted material from their PC and/or block access to the copyrighted material on their PC.
- Users are also advised that they must schedule a meeting with the Director of Computing Services to discuss steps they should take to help prevent future DMCA complaints.
- Computer Center staff will restore network access for the user's PC within 3 working days, following confirmation from The Director of Computing Services that the user understands what they can do to prevent further complaints, and what may happen if further complaints are received.
- If two or more previous complaints and a signed DMCA Complaint Acknowledgment form are on file for this user,
- Computer Center staff block the user's networked PC from connecting to the campus network, and inform the Associate Dean of Students that a repeat DMCA complaint notice has been received for the user.
- Computer Center staff send the user a copy of the DMCA complaint notice, along with instructions that they must remove the copyrighted material from their PC and/or block network access to the copyrighted material on their PC.
- Users are also advised that they must schedule a meeting with the Associate Dean of Students, who will counsel the user, and will assess penalties or fees as appropriate.
- Computer Center staff will restore network access to the user's computer within five working days after reveiving confirmation that the student has met with the Associate Dean and all appropriate penalties/fees have been assessed.
- Computer Center staff send a confirmation to the College's DMCA Agent noting that the complaint has been resolved.
